2. Purpose limitation

Data collected via your chatbot can only be used for the specific purpose you declared when you collected it. If you tell users you are capturing their email to answer their support question, you cannot route that email into a marketing list without separate consent. Each use case — support, lead generation, product feedback — requires its own documented purpose.

3. Data minimisation

Collect only what is strictly necessary. A chatbot that answers product questions does not need the user's phone number. A support widget does not need to log the user's full browsing history. Audit every data point your chatbot captures — if you cannot justify why it is necessary for the stated purpose, stop collecting it.

4. Accuracy

Personal data must be kept accurate and up to date. In the chatbot context, this applies primarily to data captured through forms: contact details collected by the widget must be correctable upon request and should not persist in a stale state indefinitely.

5. Storage limitation

Conversations cannot be retained indefinitely. You must define a retention period that is proportionate to the purpose. A typical approach: retain active support conversations for 6–12 months, anonymize or delete thereafter. Whatever period you choose, document it and enforce it technically — a written policy with no automated deletion is not compliant.

6. Integrity and confidentiality (security)

Personal data must be protected against unauthorized access, loss, or destruction. For chatbot infrastructure, this requires encryption in transit (TLS/HTTPS) and at rest, access controls limiting who can query conversation logs, and audit logging of access events. When legitimate interest applies

Legitimate interest (Article 6(1)(f)) is appropriate when processing is necessary for purposes that do not override the data subject's rights. A customer service chatbot that passively handles inbound questions — without collecting personal data through a form — can typically rely on legitimate interest. The processing improves your service; the user has a reasonable expectation that automated systems are handling their inquiry; and the privacy impact is limited to conversation content that the user themselves initiated.

A note on special category data

If your chatbot operates in healthcare, legal, financial, or HR contexts, users may disclose special category data (Article 9) — health information, legal matters, financial circumstances. The practical implication: your chatbot platform must support per-user data operations, not just account-level management. If your vendor's only deletion mechanism is "delete the entire account," that is not sufficient to meet individual rights requests at scale.

Data Residency: EU Hosting vs. SCCs vs. Adequacy Decisions

GDPR does not prohibit transferring personal data outside the EU. It requires that the transfer meets one of the conditions in Chapter V. In practice, three mechanisms dominate for chatbot deployments:

EU hosting (no transfer)
