2. Definitions

"Platform": the website www.heeya.fr and all of its features.

"Customer": any business professional holding an account on the Platform.

"AI Provider": a third-party artificial intelligence service used to deliver the Services (e.g., AWS, OpenAI, Anthropic).

"Services": services for the creation, configuration, and management of AI assistants online.

3. Purpose

These Terms of Service govern the subscription to and use of the AI assistant services offered through the Platform.

4. Access and Registration

Creating a business account, which is reserved for adults with the authority to bind their organization, is required to access the Services.

5. Description of Services

The Platform enables the creation, configuration, and management of AI assistants online, available 24/7.

• Services are immediately accessible upon payment confirmation

• Self-service use with no physical intervention required

• Remote customer support included

6. Subscription, Payment, and Termination

Subscription: The Service is provided on a monthly subscription basis with automatic renewal.

Payment: Payment is due in advance by credit card or any other method indicated on the Platform.

Termination: The Customer may cancel their subscription at any time through their personal account area; cancellation takes effect immediately and results in instant termination of access to the Services. No refund is due for any portion of the current billing period already started.

Invoicing: An invoice is issued for each payment.

7. Data and Statistics

Information provided by the Customer, as well as all documents uploaded to the Platform, are stored and used for internal statistical purposes and service improvement.

As a result of using an AI service provider (such as AWS, OpenAI, or Anthropic), certain data may transit through their platforms, in compliance with applicable regulations.

8. Deletion of Personal Data

To request the deletion of personal data, the Customer must contact [email protected] with the subject line "Personal Data Deletion". Following verification, deletion will be carried out within 30 days, unless a legal obligation requires otherwise.

9. Intellectual Property

All elements of the Platform, including the AI assistants created therein, remain the exclusive property of TENSORIA. Any reproduction, distribution, or use without prior written authorization is strictly prohibited.

10. Limitation of Liability

The publisher shall not be held liable for service interruptions, data loss, or damages resulting from misuse by the Customer, or from unavailability caused by an AI Provider.

11. Governing Law and Jurisdiction

These Terms of Service are governed by French law. Any dispute shall fall under the exclusive jurisdiction of the courts of Toulouse, France.
